SCOPE OF TERMS. These Terms apply to the Equitable Services MEDC website located at www.EquitableServicesMDEC.com (the “Equitable Services MEDC Website”). These Terms also apply to any and all online resources, materials, download areas, tools and interactive venues provided on the Equitable Services MEDC Website, including without limitation, blogs, community forums, chat rooms, discussion sites, knowledge centers, service offerings information (hereinafter, “Online Mediums”), both now and in the future.

1) any loss or damage which you may incur, including without limitation as a result of any reliance placed by you on the accuracy, completeness or suitability of the Content, or any changes Equitable Services MEDC and Equitable Services MEDC Licensors may make to the Websites, Online Mediums and Content, or any temporary interruption or permanent cessation in the provision of the Online Mediums and Content, or, if applicable, your failure to safeguard your account details or passwords.
2) to the full extent permitted by law, Equitable Services MEDC and Equitable Services MEDC Licensors are not liable for any direct, indirect, special, incidental, consequential, punitive or exemplary damages arising out of or in connection with your use of or related to the Websites, Online Mediums and Content (including without limitation for loss of or damage to business, revenues, goodwill or data) even if Equitable Services MEDC and Equitable Services MEDC Licensors had previously been advised of, or reasonably could have foreseen, the possibility of such damages, however they arise, whether in breach of contract, negligence or other tortuous action.
3) Since some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, portions of the above limitation or exclusion may not apply to you.
INDEMNIFICATION. You agree to indemnify and hold Equitable Services MEDC and Equitable Services MEDC Licensors, and each of their subsidiaries, affiliates, shareholders, officers, directors, agents, employees, and representative, harmless from any and all claims and demands, including reasonable attorneys’ fees, made by any third party arising from or relating to: (i) your use of and access to the Websites, Online Mediums and Content; (ii) content you submit, post, transmit or otherwise make available via the Website and Online Mediums; or (iii) your violation of these Terms or Website specific Terms and Conditions.
COPYRIGHTS INFRINGEMENT COMPLAINTS. You may not use the Equitable Services MEDC Website, Content or Online Mediums for any purpose or in any manner that infringes the rights of any third parties. Equitable Services MEDC encourages you to report any content on the Equitable Services MEDC Website that you believe infringes your copyright. PRIVACY POLICY
This notice provides the privacy policy of Equitable Services MEDC sharing of any Personally Identifiable Information (“PII”) or Protected Health Information (“PHI”) collected via this website. Our privacy policy explains our information practices when you provide PII or PHI to us, whether collected online or offline, or when you visit us online to browse, obtain information, or conduct a transaction, including but not limited to conducting business, interacting with our employees, filling out a form, sending an email or any similar transaction. PII may include: your name, email, mailing and/or home address, phone numbers, or other information that identifies you personally. The 18 PHI identifiers are: names, dates (except years), telephone numbers, geographic data, fax numbers, social security numbers, email addresses, medical record numbers, account numbers, health plan beneficiary numbers, certificate/license numbers, vehicle identifiers and serial numbers including license plates, web URLs, device identifiers and serial numbers, internet protocol addresses, full face photos and comparable images, biometric identifiers (i.e. retinal scan, fingerprints), and any unique identifying number or code. We do not require you to register or provide personal information to visit our website. We ask that you do not submit any PHI via the Equitable Services MEDC Website.
The PII you provide on the Equitable Services MEDC website will be used only for its intended purpose. We will protect your information consistent with the principles of the Privacy Act of 1974, 5 U.S.C. § 552a (the “Privacy Act”), the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and the Family Educational Rights and Privacy Act (“FERPA”).
PII and PHI. Generally, Equitable Services MEDC does not collect PII and PHI when you visit our website unless you choose to provide such information to us. We ask that you do not submit any PHI via the Equitable Services MEDC Website. Submitting PII through our website is voluntary and you do so at your own discretion. By doing so, you are giving Equitable Services MEDC your permission to use the PII for the stated purpose. EMAIL. Many of the pages on our websites allow you to send us an email. We will use the information you provide to respond to your inquiry. We will only send you general information via email or newsletter. You should be reminded that email may not necessarily be secure against interception. Therefore, we suggest that you do not send sensitive personal data (such as your Social Security number) to us via email. If your intended email communication is very sensitive, or includes information such as your bank account, credit card, or Social Security number, you should instead send it by U.S. mail. Another alternative may be submission of data through a secure web page, if available.
AUTOMATICALLY COLLECTED INFORMATION. We collect and temporarily store certain information about your visit for use in site management and security purposes only. We collect and analyze this information because it helps us to better design our website to suit your needs.
